Day 1 (Cont.) 'Peeking' Trial: Jane Doe 'Scared Out Of Mind' By 'Tearing' At Bedroom Window Screen

The woman who lived in the apartment that  Supervisor Efren Carrillo is charged with peeking into testified this afternoon that she awoke from a deep sleep when she heard a "tearing and scratching sound" made by someone tampering with her bedroom window screen and her blinds rustling around 3:30 a.m. on July 13.

Carrillo's neighbor on Brockhurst Drive in Santa Rosa, who is being identified as Jane Doe, testified at Carrillo's peeking trial that she did not look out her bedroom window and does not know if someone was looking inside her room early that morning.

"I was scared out of my mind," she testified. Doe said she grabbed her gown, went to the living room where two female guests were sleeping and looked out her front window.

Doe said she saw a man in his underwear with his hands on his hips standing in front of her house.

She said the man looked "very scary, large and muscular."

Doe said she woke her two friends, traveling nurses who were staying with her that weekend, and called police. She testified her first 911 call at 3:40 a.m. didn't go through and that she called 911 again at 3:50 a.m.

She said she and her friends armed themselves with butcher knives. Doe said she heard a knock on the door and was hoping it was the police, and she asked 'Who is it?'

The man responded, 'It's your neighbor,' Doe said. "I asked, 'What do you want?' and he said 'a drink.'" Doe said. "I told him to hold on a minute to keep him there until police arrived," she said.

Doe testified she did not know the man outside her door was Carrillo until she saw police shining a flashlight in his face outside.

The defense claims Carrillo told Doe at the door, "It's Efren, your neighbor."

Police arrived and Carrillo, 33, was arrested for burglary and prowling.

In November he was charged with the misdemeanor peeking count.

Doe said she and Carrillo had interacted three times before July 13, twice on the same day in May and once in June.

In mid-May Carrillo introduced himself to her and her friend Dave outside her apartment, Doe testified.

Later that day she had a brief "5-second" conversation when she encountered Carrillo and his girlfriend at the Space XXV nightclub in Santa Rosa, Doe said.

"I said 'hi' and thought it was a coincidence I saw him earlier that day," she said.

In June, Carrillo showed up uninvited with a bottle of wine at the sliding door in the back of her apartment to welcome her to the neighborhood, Doe said.

"I was a little shocked to see him," she said. "I said 'thank you' and he leaned in the door and gave me an air kiss and a hug," Doe said.

She said she did not hug Carrillo and was taken aback by his behavior. Doe said Carrillo has never been in her apartment, and she denied she and Carrillo were romantically involved.

On recorded interviews by police, Carrillo said he went to his neighbor's house with two beers when he saw a light on in her apartment.

Carrillo told police he had four drinks at Space XXV before he was dropped off at home around 2:30 a.m. Santa Rosa police police officer Chris Diaz, who was the first officer to respond to the prowling call, testified Carrillo was wearing socks and underwear and carrying a cellphone when he arrived.

Carrillo said he has just come from a neighbor's house, Diaz said.

Diaz said Carrillo's eyes were glassy and he had alcohol on his breath, but he did not give Carrillo a field sobriety test because he had no trouble walking, standing, and understanding and answering questions.

Diaz said he was investigating a possible prowler call at the time, and Carrillo was not intoxicated to the point where he was unable to care for his own safety.

"There wasn't anything more than the smell of alcohol, Diaz said.

 He said it was as if Carrillo had some beers. "He was able to converse. He wasn't so drunk that it was a violation of the law. He wasn't even close," Diaz said.

Testimony resumes 10 a.m. Wednesday.
