Day 1 of 'Peeking' Trial: Jane Doe's Testimony Begins in Case Against Supervisor Carrillo

Testimony began this morning at Sonoma County Supervisor Efren Carrillo's trial, where the woman whose apartment Carrillo allegedly peeked into took the witness stand.

Carrillo, 33, the county's 5th District supervisor, is charged in Sonoma County Superior Court with peeking into the window of the woman's west Santa Rosa apartment around 3:30 a.m. on July 13, 2013.

The woman, who is being identified as Jane Doe, testified that two female visitors were staying in her apartment on the night in question.

In recorded interviews with Santa Rosa police, Carrillo said he went to the woman's apartment with two beers after he saw a light on in her apartment and knocked on the front door.

He said he left when he heard a male inside the apartment say, "What the hell?" Santa Rosa police had initially arrested Carrillo on suspicion of burglary and prowling.

Prosecutors did not file those charges against him, but allege that Carrillo bent the screen on the woman's bedroom window and reached inside.

In opening statements in Judge Gary Medvigy's packed courtroom, defense attorney Chris Andrian said there is no evidence Carrillo peeked inside the window.

Andrian said the only mention of peeking to support the complaint is from Carrillo, who he said told police he peeked around the corner of a patio at the rear of the apartment to see if a light was on.

"You might not like what he did, but he didn't commit a crime," Andrian told the jury, which consists of 11 women and three men, including two alternates.

Napa County Deputy District Attorney Cody Hunt told the panel Jane Doe was frightened by a man dressed only in boxer briefs and socks and she armed herself with a butcher knife when he knocked on the front door and identified himself as her neighbor.

"That man is the defendant Efren Carrillo," Hunt said.

Hunt said Carrillo and Jane Doe, a secretary at Kaiser Permanente Medical Center, had three previous "interactions," once at the Space XXV nightclub in Santa Rosa and two uninvited times at Jane Doe's apartment.

Hunt also told the jury Carrillo admitted to police that the incident was "not my smartest time, I'll tell you that," and that Carrillo said in retrospect that he should have had a shirt and pants on.

Jane Doe's testimony continues this afternoon.
